General Terms and Conditions of Nino Mai Arbeitsschutz GmbH

§1 Scope and Definitions

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their self-employed professional activity (§ 13 German Civil Code – BGB).

§2 Conclusion of Contract and Storage of Contract Text

(1) The following provisions regarding the conclusion of the contract apply to orders placed via our online shop at http://www.multicare-family.de.

(2) In the event of the conclusion of a contract, the contract is concluded with:

(3) The presentation of goods in our online shop does not constitute a legally binding offer on our part, but merely a non-binding invitation for the consumer to place an order. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.

(4) Upon receipt of an order in our online shop, the following provisions apply: The consumer submits a binding contractual offer by successfully completing the order procedure provided in our online shop.

The order process consists of the following steps:

1) Selection of the desired goods
2) Confirmation by clicking the “Order” button
3) Review of the information in the shopping cart
4) Clicking the “Proceed to Checkout” button
5) Logging into the online shop after registration and entering login details (email address and password)
6) Final review and correction of the entered data
7) Binding submission of the order by clicking the “Order with obligation to pay” or “Buy” button

Before submitting the binding order, the consumer can return to the page where customer details are recorded and correct any input errors by using the “Back” button of the internet browser, or cancel the order process by closing the browser.

We confirm receipt of the order immediately by means of an automatically generated email (“Order Confirmation”). By doing so, we accept the offer.

(5) Storage of the contract text for orders placed via our online shop: We send you the order data and our Terms and Conditions by email. You can also view the Terms and Conditions at any time at http://www.multicare-family.de. For security reasons, your order data are no longer accessible via the internet.

§3 Prices, Shipping Costs, Payment, Due Date

(1) The prices stated include statutory VAT and other price components. Any shipping costs incurred will be added.

(2) The consumer has the option to pay by advance payment or direct debit.

(3) If the consumer chooses advance payment, they undertake to pay the purchase price immediately after the conclusion of the contract.

§4 Delivery

(1) Unless otherwise clearly stated in the product description, all items offered by us are ready for dispatch immediately. Delivery shall take place no later than within 5 working days. In the case of advance payment, the delivery period begins on the day after the payment order is issued to the transferring bank, and for all other payment methods on the day after the contract is concluded. If the deadline falls on a Saturday, Sunday, or public holiday at the place of delivery, it shall end on the next working day.

(2) The risk of accidental loss or accidental deterioration of the sold goods shall pass to the buyer only upon delivery of the goods, even in the case of shipment.

§5 Retention of Title

We retain ownership of the goods until full payment of the purchase price has been made.

§6 Consumer Right of Withdrawal

Right of Withdrawal for Consumers

Consumers have a right of withdrawal under the following conditions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their self-employed professional activity.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods.

To exercise your right of withdrawal, you must inform us:

by means of a clear declaration (e.g. a letter sent by post, fax, or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but this is not mandatory.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (with the exception of additional costs resulting from choosing a type of delivery other than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal.

We will use the same means of payment for the reimbursement that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us without delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal. The deadline is met if you send the goods before the fourteen-day period has expired.

You bear the direct costs of returning the goods.

Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to distance contracts:

  • for the delivery of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;
  • for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
